• Federal law (2018 Farm Bill): Hemp-derived THCa products are legal nationwide as long as they test below 0.3% delta-9 THC by dry weight. Every Miracle of the Desert product meets this standard.
• Texas state law: In early 2026, Texas state agencies attempted to enforce new rules that would have effectively banned smokable THCa flower and many other hemp-derived products. The Texas Hemp Business Council and Hemp Industry & Farmers of America sued.
• Court ruling: On May 1, 2026, a Texas state district court issued a temporary injunction (Case #789244, Judge Daniella DeSeta Lyttle) blocking Texas from enforcing those rules. The judge found that Texas regulators had bypassed the legislature when they implemented the rules.
• Current status: The injunction extends through at least July 27, 2026. During this period, Miracle of the Desert products are legal to ship to Texas.

What happens after July 27, 2026?

The court will either extend the injunction, replace it with a permanent order, or let it expire. If it expires without further legal protection, Texas could resume enforcement of its rules. We monitor this case daily and will update our shipping policy and customer guidance immediately if anything changes.

Could my order be seized?

THCa (tetrahydrocannabinolic acid) is a naturally occurring cannabinoid found in raw hemp flower — most abundant in the trichomes, the resin glands on the outside of the flower. THCa is the precursor to THC.

When heat is applied (through smoking, vaping, or cooking), THCa converts to THC — a process called decarboxylation. The extra carboxyl group on the THCa molecule comes off when heated.

Yes, according to federal law, harvested THC-A hemp flower is legal. This stems from the 2018 Farm Bill’s distinction between legal hemp and illegal marijuana, which is based on delta-9 THC levels, not CBD or cannabinoid total content. Legally, harvested cannabis, including its flowers and buds, is considered hemp and lawful if it contains no more than 0.3% delta-9 THC by dry weight, irrespective of the levels of THC-A or other cannabinoids like THC-A. Furthermore, the federal Controlled Substances Act excludes hemp from the definition of marijuana, meaning hemp is not classified as an illegal controlled substance under federal law. However THC-A may be restricted to certain states, see “Where do you deliver” above.
