Yes, according to federal law, harvested THC-A hemp flower is legal. This stems from the 2018 Farm Bill’s distinction between legal hemp and illegal marijuana, which is based on delta-9 THC levels, not CBD or cannabinoid total content. Legally, harvested cannabis, including its flowers and buds, is considered hemp and lawful if it contains no more than 0.3% delta-9 THC by dry weight, irrespective of the levels of THC-A or other cannabinoids like THC-A.
