What is THC-A?
THC-A, or tetrahydrocannabinolic acid, is a cannabinoid predominantly present in the trichomes and crystals of cannabis, and it can also be derived from hemp. Serving as the precursor to delta-9 THC, THCaA transforms into a substance offering effects comparable to traditional THC when subjected to heat.
Is THC-A hemp flower legal?
Yes, according to federal law, harvested THC-A hemp flower is legal. This stems from the 2018 Farm Bill’s distinction between legal hemp and illegal marijuana, which is based on delta-9 THC levels, not THC-A content. Legally, harvested cannabis, including its flowers and buds, is considered hemp and lawful if it contains no more than 0.3% delta-9 THC by dry weight, irrespective of the levels of THC-A or other cannabinoids like CBD. Furthermore, the federal Controlled Substances Act excludes hemp from the definition of marijuana, meaning hemp is not classified as an illegal controlled substance under federal law. However THC-A may be restricted to certain states, see “Where do you deliver” above.
