What is THC-A?
THC-A, or tetrahydrocannabinolic acid, is a cannabinoid predominantly present in the trichomes and crystals of cannabis, and it can also be derived from hemp. Serving as the precursor to delta-9 THC, THCaA transforms into a substance offering effects comparable to traditional THC when subjected to heat.
Is THC-A hemp flower legal?
Yes, according to federal law, harvested THC-A hemp flower is legal. This stems from the 2018 Farm Bill’s distinction between legal hemp and illegal marijuana, which is based on delta-9 THC levels, not THC-A content. Legally, harvested cannabis, including its flowers and buds, is considered hemp and lawful if it contains no more than 0.3% delta-9 THC by dry weight, irrespective of the levels of THC-A or other cannabinoids like CBD. Furthermore, the federal Controlled Substances Act excludes hemp from the definition of marijuana, meaning hemp is not classified as an illegal controlled substance under federal law.
